These Terms of Service (“Terms”) are a contract between you and Circle VPN (“Circle,” “we,” “us”) for the Circle VPN apps and the websites at https://circle.tools and https://www.circle.tools (together, the “Service”).
By creating an account, connecting, or buying a plan, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the Service.
These Terms are between you and Circle only. Apple is not a party to these Terms. Google is not a party to these Terms. Extra terms for the App Store and Google Play are in sections 10 and 11.
1. The service
1.1 Circle VPN provides an encrypted virtual private network. On iOS and macOS the tunnel uses Apple’s Network Extension. On Android the tunnel uses Android’s VpnService. Traffic is encrypted between your device and the Circle server you select.
1.2 The Service is a network connection. It does not make you anonymous in every case, and it does not guarantee that a particular site, app, or network will be reachable. Your carrier, the sites you visit, and the laws where you are still apply to you.
1.3 We may change servers, protocols, and features, and we may pause the Service for maintenance. Plans and device limits shown in the app or on the website at the time you buy are part of these Terms.
2. Who may use Circle
2.1 You must be at least 16 years old, or older if the law where you live requires a higher age to consent or to enter a contract. If you are under 18, you may use the Service only with a parent or guardian who agrees to these Terms. The Service is not directed to children under 13.
2.2 You must give a valid email address, keep your password confidential, and be responsible for activity under your account. Tell us at support@circlevpn.com if you believe the account is being used without your permission.
3. Acceptable use
You will not use the Service to:
- break the law, or infringe someone else’s rights;
- distribute malware, attack or scan systems without authorization, or interfere with a network or with Circle;
- send spam or unsolicited bulk messages;
- resell, rent, or share the Service beyond the device limit of your plan;
- reverse engineer the apps except where the law where you live does not allow that limit.
We may suspend or close an account that breaks these Terms or that creates a security or legal risk.
4. Plans and prices
4.1 Some features require a paid plan. The name, length, price, and whether the plan renews are shown before you confirm the purchase. Taxes may be added by the store or checkout.
4.2 Subscriptions. A plan marked as a subscription renews until you cancel it. The app states: subscriptions auto-renew unless turned off at least 24 hours before the end of the current period. You are charged when you confirm the purchase. You can manage or cancel at any time in your store account settings.
4.3 One-time plans. A plan marked as a one-time purchase does not auto-renew. It lasts for the period shown at purchase.
4.4 A free trial or introductory period, if we offer one, is described before you confirm it. If you do not cancel a renewing plan before the trial ends, the store may charge the price shown for the plan.
5. App Store billing
5.1 Plans bought inside the iOS or macOS app are sold by Apple and charged to your Apple ID. Circle does not receive your payment-card number.
5.2 Manage or cancel an App Store subscription in Settings → Apple ID → Subscriptions. Cancel at least 24 hours before the period ends to avoid the next charge. Deleting your Circle account does not cancel the App Store subscription.
5.3 You can restore an active App Store purchase from the subscription screen in the app, using the same Apple ID.
5.4 Refunds of App Store purchases are handled by Apple under Apple’s policies.
6. Google Play billing
6.1 Plans bought inside the Android app are sold by Google and charged to your Google account. Circle does not receive your payment-card number.
6.2 Manage or cancel a Google Play subscription in the Play Store, under Payments and subscriptions. Cancel at least 24 hours before the period ends to avoid the next charge. Deleting your Circle account does not cancel the Google Play subscription.
6.3 Refunds of Google Play purchases are handled by Google under Google’s policies.
7. Website purchases
7.1 A plan bought on circle.tools is billed by the checkout shown on that page. That purchase is separate from an App Store or Google Play subscription. Paying on the website does not cancel a store subscription.
7.2 If a website plan renews, the renewal terms are shown before you pay. To cancel a renewing website plan, email support@circlevpn.com from the account email before the next renewal date.
8. Privacy
The Privacy Policy describes the information Circle collects and how it is used. Circle does not sell that data and does not share it with third parties for analytics, advertising, or any other purpose. The contents of your VPN traffic are used only to provide the connection you start.
9. License and intellectual property
9.1 Circle grants you a personal, non-exclusive, non-transferable, revocable license to install and use the apps, in object code, on devices you own or control, within the device limit of your plan and subject to these Terms and the store rules that apply to the download.
9.2 Circle VPN, the apps, and the website content are owned by Circle or its licensors. You receive no ownership. All rights that are not expressly granted stay with Circle. Open-source components remain under their own licenses.
10. Additional terms for the Apple App Store
If you downloaded an app from the Apple App Store, this section also applies, and it controls if it conflicts with another section about that app.
10.1 Parties. These Terms are concluded between you and Circle only, and not with Apple Inc. (“Apple”). Circle, not Apple, is solely responsible for the app and its content.
10.2 License scope. The license is limited to a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. These Terms do not allow use that conflicts with those Usage Rules.
10.3 Support. Circle is solely responsible for maintenance and support of the app. Apple has no obligation to furnish any maintenance or support.
10.4 Warranty. Circle is solely responsible for any product warranties, whether express or implied, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Circle’s sole responsibility.
10.5 Product claims. Circle, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product-liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
10.6 Intellectual property. If a third party claims that the app, or your possession and use of it, infringes that party’s intellectual property rights, Circle, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
10.7 Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
10.8 Third-party terms. You must comply with applicable third-party terms when using the app, including your wireless-data service agreement.
10.9 Third-party beneficiary. You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
10.10 Developer contact. Circle VPN, support@circlevpn.com, https://www.circle.tools.
11. Additional terms for Google Play
If you downloaded an app from Google Play, this section also applies.
11.1 These Terms are between you and Circle. Google LLC and its affiliates (“Google”) are not responsible for the app, its content, or its support.
11.2 Digital plans inside the Android app are billed only through Google Play. You will comply with the Google Play Terms of Service when you download or buy through Google Play.
11.3 The Android app uses VpnService to provide the VPN described in these Terms. It encrypts traffic between your device and Circle’s servers. It does not use the VPN to collect data for advertising or to redirect traffic for ads.
12. Disclaimers
12.1 To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
12.2 We do not warrant that the Service will be uninterrupted, error-free, or available in every location, or that it will meet a particular security or legal outcome.
12.3 Nothing in these Terms excludes or limits a warranty or right that the law where you live does not allow us to exclude or limit, including non-waivable consumer rights.
13. Limitation of liability
13.1 To the maximum extent permitted by law, Circle and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of the Service or these Terms.
13.2 To the maximum extent permitted by law, Circle’s total liability for a claim relating to the Service or these Terms will not exceed the greater of the amount you paid Circle for the Service in the 12 months before the claim, or USD $50.
13.3 These limits do not apply to liability that cannot legally be limited, including liability for fraud, or for death or personal injury caused by negligence, or any non-waivable consumer right.
14. Your responsibility for misuse
To the extent permitted by law, you will indemnify Circle against claims, damages, and reasonable expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of the law. This does not apply to the extent the claim is caused by Circle, and it does not limit rights you cannot waive.
15. Stopping the service
15.1 You may stop using the Service at any time and delete the app. You may delete your account as described on the account deletion page. Deleting the account does not cancel a store subscription.
15.2 We may suspend or end access if you materially break these Terms, if the law requires it, or to protect the Service. Sections that by their nature should continue — including intellectual property, disclaimers, liability limits, store-specific terms, and this survival sentence — continue after the Service ends.
16. Export
You will comply with applicable export-control and sanctions laws. You represent that you are not prohibited from using the Service under those laws, and you make the representation in section 10.7.
17. Changes to these Terms
We may update these Terms. We will post the new version on this page and change the date above. If a change is material, we will provide additional notice where the law requires it, such as a notice in the app. If you continue to use the Service after the update takes effect, you accept the updated Terms, except where the law requires your explicit consent.
18. Law and disputes
18.1 Mandatory consumer-protection laws of the country where you live still apply to you, and these Terms do not take those rights away.
18.2 Subject to section 18.1, these Terms are governed by the laws that apply to Circle VPN, without regard to conflict-of-law rules.
18.3 Please contact support@circlevpn.com first so we can try to resolve a dispute. Except where the law where you live requires a local forum, the courts that have jurisdiction over Circle VPN may hear a dispute that is not resolved informally.
19. Whole agreement
These Terms, the Privacy Policy, and the plan details shown at purchase are the whole agreement between you and Circle about the Service. If a court holds one provision unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver.
